Assumption of the Risk, and Waiver of Liability, while Undertaking Group Cycling under Social Distancing and Related Guidelines/Regulations as a Result of Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organisation. COVID-19 is extremely contagious and is believed to spread mainly by airborne droplets and from person-to-person contact. As a result, the Government has imposed social distancing and other guidelines/regulations. Wheel Easy Leisure Cycling Ltd (WELC) is following these by allowing up to 6 cyclists to ride as a group, provided social distancing of 2 metres or 1+ metres with mitigation takes place. All members acknowledge that they will do their best to maintain this spacing as well as possible, but understand the difficulty of doing it throughout the ride and will in no way hold WELC directors and members responsible.

WELC has put into place, as well as is possible during group rides, preventative measures to help reduce the spread of COVID-19; however, attending WELC rides could increase your risk of contracting COVID-19, and WELC cannot guarantee that you will not become infected with COVID-19. WELC members, by agreeing to this waiver, acknowledge that they have read “WELC’s Requirements for Group Riding under COVID-19” and agree that they will, to the best of their ability, follow these rules.

By indicating your consent to this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you may be exposed to or infected by COVID-19 by participating in a WELC ride and that such exposure or infection may result in personal injury, illness, permanent disability and death. You also confirm that you understand that the risk of becoming exposed to or infected by COVID-19 at a WELC ride may result from the actions, omissions, or negligence of yourself and others, including, but not limited to, WELC directors, other ride participants, and members of the public.

You voluntarily agree to assume all of the risks and accept sole responsibility for any injury to yourself (including, but not limited to personal injury, disability and death). On your own behalf, you hereby release, covenant not to sue, discharge, and hold harmless WELC, its directors and other members of WELC, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. You understand and agree that this release includes any claims based on the actions, omissions, or negligence of WELC, its directors or other members, whether a COVID-19 infection occurs before, during, or after participation in any WELC ride.
